These Terms and Conditions govern your access to and use of do4kind.com and all associated content, features, and services. The Site is owned and operated by Do4Kind Australia Pty Ltd registered at Suite 329, 98–100 Elizabeth Street, Melbourne VIC 3000, Australia.
Applies to everyone visiting or using do4kind.com regardless of product interaction.
Applies in addition to Layer 1 if you register a member or artist account.
Specific rules for products like Kindness Notes, Wristband Project, & do4kind Check.
Acceptance of These Terms
These Terms and Conditions ("Terms") govern your access to and use of do4kind.com and all associated content, features, and services (together, the "Site"). The Site is owned and operated by Do4Kind Australia Pty Ltd ("do4kind," "we," "us," or "our"), registered at Suite 329, 98–100 Elizabeth Street, Melbourne VIC 3000, Australia.
By visiting, browsing, registering on, or otherwise using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
- Layer 1 — Site-wide Terms: Applies to everyone who uses do4kind.com, regardless of which product or feature they engage with.
- Layer 2 — Account/Registration Terms: Applies in addition to these Terms if you create an account.
- Layer 3 — Product-specific Terms: Applies in addition to these Terms for individual products and features, such as Kindness Notes, the Wristband Project, and do4kind Check.
Where a more specific layer conflicts with these site-wide Terms on a particular point, the more specific terms govern for that product or feature. Our separate Privacy Policy explains how we collect and use information and is incorporated into these Terms by reference.
Eligibility
You must be at least 18 years old to register an account, make a purchase, or otherwise use the Site. By using the Site, you represent that you meet this requirement.
do4kind does not knowingly direct any part of the Site, or collect personal information, from anyone under 18.
Our Products and Services
do4kind operates a growing family of kindness-focused products and features offered under this single Site:
A free, anonymous, click-through behavioral question tool accessed directly from the homepage. No account, survey, or prize structure is involved.
A line of hand-drawn, numbered art pieces sold through our shop, each with a serial number used to track ownership as pieces are gifted or passed along.
A physical product line and enrollment setup sold and managed through the Site.
We are also developing additional products (including concepts such as Stop Waste, Coffee Forward, Tipping & Thanksgiving, Friendship Jar, and Cross My Mind). As each launches, it will be covered by these site-wide Terms plus its own product-specific terms (Layer 3). We may add, change, or discontinue any product or feature at any time.
Accounts and Registration
Some features may require you to create an account. If you do, you agree to:
- Provide accurate, current, and complete information;
- Keep your login credentials confidential and secure; and
- Notify us promptly of any unauthorized use of your account.
You are responsible for all activity that occurs under your account. Where you register for an account, our separate account/registration terms (Layer 2) apply in addition to these Terms.
Acceptable Use
When using the Site, you agree not to:
- Break any applicable law or regulation;
- Impersonate any person or entity, or misrepresent your affiliation with anyone;
- Interfere with, disrupt, or attempt to manipulate do4kind Check or any other feature (including submitting automated, bulk, or bad-faith responses);
- Scrape, harvest, or extract data from the Site by automated means without our prior written consent;
- Upload or transmit viruses, malware, or other harmful code;
- Attempt to gain unauthorized access to the Site, other users' accounts, or our systems; or
- Use the Site to harass, abuse, or harm another person.
We reserve the right to suspend or terminate access for anyone who violates this section.
Purchases, Pricing, Shipping, and Returns
Some products (including Kindness Notes and Wristband Project items) are sold through the Site, with checkout handled by our third-party commerce platform (currently Shopify).
- Pricing: Prices are shown at checkout and may change at any time before you complete an order. Where individual pieces or bundles are offered (for example, a two-piece package), the applicable price is the one shown at checkout.
- Payment: Payment is processed by our commerce and payment providers, subject to their own terms. We do not store your full payment card details.
- Availability: Because pieces such as Kindness Notes are individually numbered and limited, an item may sell out or be withdrawn before your order is confirmed; if that happens, we will cancel and refund the affected item.
- Shipping: We aim to ship orders worldwide within the timeframe stated on the product page. Delivery times are estimates, not guarantees, and international orders may be subject to customs delays or import duties payable by you.
All sales are final. We do not accept returns or offer refunds for change of mind or any other reason, except where a return or refund cannot lawfully be excluded — including non-excludable consumer guarantees under the Australian Consumer Law or equivalent consumer protection law in your country of residence (for example, where an item is faulty, not as described, or not fit for purpose).
Intellectual Property
All content on the Site — including text, graphics, logos, the do4kind name and marks, and the artwork, verses, and "Social Credit" concept behind Kindness Notes — is owned by do4kind or its licensors and protected by copyright, trademark, and other laws.
We grant you a limited, non-exclusive, non-transferable license to view the Site and, where you purchase one, to own your physical Kindness Note or other product. This does not give you any right to reproduce, distribute, publicly display, or create derivative works from our artwork, branding, or other content without our prior written permission.
Any feedback or suggestions you send us about the Site or our products may be used by do4kind without obligation to you.
Kindness Notes Ownership-Tracking Registry
Each Kindness Note carries a unique serial number that we use to keep an informal record of its journey — its original buyer and any later transfers between people who choose to pass it on as an act of kindness.
This registry is a voluntary record-keeping tool for storytelling and tracking purposes only. It is NOT:
- A financial instrument, security, share, or investment product;
- A cryptocurrency, token, or blockchain-based asset (records are kept in a conventional database, not a blockchain); or
- A guarantee of resale value, authenticity of any specific transfer, or any legal ownership right beyond that of a normal physical artwork purchase.
We rely on the honesty of participants when recording transfers and do not independently verify each handoff. do4kind is not responsible for disputes between individuals over who currently or previously held a given Kindness Note.
do4kind Check
do4kind Check is a free, anonymous, click-through tool meant to prompt brief self-reflection on everyday behavior.
It is offered for general interest and engagement purposes only and is not medical, psychological, legal, financial, or other professional advice, and should not be relied on as such. If you have concerns about your health or wellbeing, please consult a qualified professional.
Because do4kind Check requires no registration, we do not collect information that identifies you personally through it; responses are handled as described in our Privacy Policy.
Third-Party Services and Links
The Site relies on and links to third-party services, including our commerce/checkout provider (Shopify), payment processors, email hosting, and social media accounts (Facebook, Instagram, LinkedIn, X).
These third parties operate under their own terms and privacy policies, which we encourage you to review. do4kind is not responsible for the content, security, or practices of any third-party service or site.
Disclaimers and Limitation of Liability
The Site and all products and features are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
To the maximum extent permitted by law, do4kind will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Site or any product.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded, restricted, or modified — including guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) and equivalent consumer protections that may apply to you in the EU, UK, or US. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the goods or services or paying the cost of doing so.
Indemnification
You agree to indemnify and hold do4kind, its officers, employees, and agents harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.
Governing Law and Dispute Resolution
These Terms are governed by the laws of Victoria, Australia, without regard to conflict-of-law principles, even though the Site is offered to users globally, including in the US, EU, and UK.
If you are a consumer resident in the EU, UK, or a US state, you may also be entitled to rely on mandatory consumer protection provisions of your own place of residence, which this section does not override.
Any dispute arising out of or relating to these Terms or the Site will be subject to the non-exclusive jurisdiction of the courts of Victoria, Australia.
Changes to These Terms; Termination
We may update these Terms from time to time, for example as new products launch or laws change. We will post the updated version on this page with a new effective date; where changes are significant, we will make reasonable efforts to give more visible notice (e.g., a Site banner or email if you have an account).
Continued use of the Site after an update means you accept the revised Terms.
We may suspend or terminate your access to the Site or any account, with or without notice, if we reasonably believe you have violated these Terms. You may stop using the Site, or request deletion of your account, at any time.
Privacy and Contact
Our Privacy Policy explains what information we collect and how we use it, and forms part of these Terms.
If any part of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with the Privacy Policy and any applicable Layer 2 or Layer 3 terms, are the entire agreement between you and do4kind regarding the Site.
